RH Borden – Field Services Terms & Conditions

These Terms & Conditions (“Terms”) apply to all field services provided by RH Borden (“Contractor”) to the customer (“Client”). By accepting an estimate, the Client agrees to these Terms.

1. Scope of Services

Contractor provides field services for wastewater collection systems, including but not limited to:

  • Acoustic assessment using the Sewer Line Rapid Assessment Tool (SL-RAT®)
  • Manhole scanning and inspection including Level 1 and Level 2 using Manhole Virtual Models (MVM)
  • Inflow and infiltration (I&I) studies using BASINiQ®

Services are performed according to the estimate provided. These Terms outline additional conditions that may affect cost, schedule, or deliverables.

2. Client Responsibilities

To ensure efficiency and accurate completion of work, the Client is responsible for:

  • Providing accurate GIS maps and system data unless otherwise agreed upon prior to engagement.
  • Ensuring manholes are accessible, unburied, and free from obstructions.
  • Coordinating access to gated or restricted areas.
  • Identifying areas that require traffic control prior to scheduling.

Failure to meet these responsibilities may result in additional charges.

3. Conditions Affecting Productivity & Additional Charges

Field services rely on maintaining a consistent pace of work. Circumstances outside Contractor’s control may slow progress. The following conditions will result in additional charges:

  1. Buried, Missing, or Inaccessible Manholes
    1. If a manhole cannot be located within five (5) minutes, or access is hindered by obstructions, locked gates, easements, or difficult terrain, an upcharge of $20 per manhole will apply.
  2. Traffic Control/Permit Requirements
    1. Traffic control will be billed at $2,000 per day or cost plus 10%, whichever is greater.
    2. Permit Costs will be charged at costs plus 10%.
  3. Delays Due to Client-Related Issues
    1. If Contractor’s teams are delayed due to the Client’s failure to prepare the worksite (e.g., manholes not unburied as previously agreed), standby charges of $2,500 per day or $350 per hour will apply.
  4. Manhole Spacing & Testing Intervals
    1. Acoustic testing is performed from manhole to manhole. Closer spacing results in more frequent inspections per foot of sewer line. Pricing is based on linear footage; however, additional manholes per foot increase time and cost. If the average pipe length between manholes for the total pipe assessed is less than 200 feet, an adjustment of $0.03 per foot will be reflected in the final invoice.

4. Billing & Payment

  • Invoices will reflect the base estimate plus any applicable additional charges outlined in Section 3.
  • Payment terms are net 30 days unless otherwise stated in the estimate.
  • Failure to pay within the terms will result in a monthly penalty of 7% of the outstanding balance.

5. Safety & Access

Contractor prioritizes crew safety. Work may be paused or rescheduled if unsafe conditions exist, including but not limited to: inadequate traffic control, hazardous access, or environmental risks. Costs associated with delays due to unsafe or inaccessible conditions are billable under Section 3.

6. Limitations

Contractor is not responsible for delays caused by weather, third-party utility conflicts, or other circumstances beyond its control.

7. Acceptance

By authorizing services or approving an estimate, the Client acknowledges and accepts these Terms & Conditions.
